This information is made available for the purpose of complying with 13 V.S.A. section 5401 et seq., which requires the Department of Public Safety to establish and maintain a registry of persons who are required to register as sex offenders and to post electronically information on sex offenders. The registry is based on the legislature's decision to facilitate access to publicly available information about persons convicted of sexual offenses.

This service does not contain the names of all the registered sex offenders in Vermont. Please contact your local law enforcement agency or the Vermont Sex Offender Registry at (802) 241-5400 ([email protected]) for further information.

Except for offenders specifically designated on this site as HIGH-RISK, the Department of Public Safety has not considered or assessed the specific risk of re-offense with regard to any individual prior to his or her inclusion within this registry and has made no determination that any individual included in the registry is currently dangerous. The main purpose of providing this data on the internet is to make information more easily available and accessible, not to warn about any specific individual.

According to the law, a sex offender who stays in Vermont for 10 straight days now lives in the state. The offender will have to register in the state if convicted in another state on or after July 1, 1995.

A sex offender registered in Vermont but who wishes to move to another state must inform the VCIC about his/her plans. Such an offender must submit their new address to the Vermont Crime Information Center (VCIC). He/she must also register with the Sex Offender Register of the new state within 3 days of relocation.

A person who is convicted of any of the following offenses against a victim who is a minor, except that, for purposes of this subdivision, conduct which is criminal only because of the age of the victim shall not be considered an offense for purposes of the registry if the perpetrator is under the age of 18:

(12) if the offender has not been subject to a risk assessment, a statement that the offender has not been so assessed and that such a person is presumed to be high risk, provided that the Department of Corrections shall permit a person subject to this subdivision to obtain a risk assessment at the person's own expense.

(c) The Department shall have the authority to take necessary steps to obtain digital photographs of offenders whose information is required to be posted on the Internet and to update photographs as necessary. An offender shall annually report to the Department or a local law enforcement agency for the purpose of being photographed for the Internet.

(e) Information regarding a sex offender shall not be posted electronically if the conduct that is the basis for the offense is criminal only because of the age of the victim and the perpetrator is within 38 months of age of the victim.

(f) Information regarding a sex offender shall not be posted electronically prior to the offender reaching 18 years of age, but such information shall be otherwise available pursuant to section 5411 of this title.

Local law enforcement agencies and the Vermont Crime Information Center are authorized to release relevant registry information to the public when the requestor can articulate a specific concern about their safety or the safety of another. The Barre City Police Department assists with quality control by conducting residency compliance checks and investigating complaints regarding the registration of sex offenders within the City of Barre in conformance with Vermont Statutes Annotated.

According to an affidavit by Bennington Police Detective Anthony Silvestro on Aug. 11 he was notified by a police dispatcher that it appeared as though Silva was living on Silver Street when his address with the sex offender registry had him living in Woodford. The dispatcher told Silvestro the matter came to police attention after a welfare check at the Silver Street residence had been conducted.

According to the affidavit, Silva was convicted in North Adams (Mass.) District Court of indecent assault and battery on Dec. 12, 2007. Such an offense requires a person to register as a sex offender.
